@Newmy Unfortunately, this is the only way to do it. I mean, how could we have social media that wasn't owned by some billionaire?

@gulovsen If I remember correctly, IBM's dominance (in reputation, size, tech, patents) gave it advantages that would forever preserve that dominance. Similar arguments apply to many monopoly or monopolistic positions, and those arguments are correct unless the weight of dominance creates problems or something about the world changes

@ivyfox @laminda I've seen impressive robin nests taking advantage of anti-bird spikes.

@ivyfox @laminda Even better. Those spiny things are immobile so they provide a nice foundation!

@Teri_Kanefield My criminal practice has been entirely in State courts, but my experience says taking a year to get to trial isn't unusual, especially in a high stakes or complex case. Trial dates get set within the speedy trial time line but are often delayed usually on defense request. Is a typical Federal case tried within the speedy trial deadline?

  • View post

@trabern @Teri_Kanefield A big part of the difference may be prosecutorial resources. My client, if not incarcerated, rarely wants a speedy trial. The prosecutor's office (with 1 1/2 attorneys) has a few hundred other cases pending so is probably not in a hurry to prioritize the one that I want to delay. Eventually, the judge says, 'this case is getting old, I'm setting it for trial.'

@alysondecker @design_law Maybe they're trying to subtly shift the narrative. Would be prefer the comparison to a mustard stain over a Cheeto?

@alysondecker Well the he is the orange man so who knows and maybe I just didn't want to consider the obvious alternatives

@KayseeColorado @Teri_Kanefield It depends on the Judge. A good judge will do their best not to punish the defendant for having an attorney who annoys them or wastes their time. But an attorney can lose credibility with a judge. It's hard to win a novel or creative argument if the judge thinks you're a clown

@design_law In the valuable or interesting category is updates on what's happening in the legal world, best with a little analysis or explanation attached. In the useful category: the same but in the criminal law world.

@servelan It was such a bizarre motion, they should have called it a motion to squash the report. (BTW, the title is stolen from hundreds of my client's who have asked me to get a warrant 'squashed'.)

A little more than a year ago, the Illinois legislature passed the Pre-Trial Fairness Act, which, among other things, eliminated cash bond. It was to take effect on January 1 but was stayed by the Illinois Supreme Court pending decision on various cases. We are expecting the decision this morning on whether it becomes effective and in what form. There are so many possible outcomes that I almost wish I had set up a betting pool. Assuming we get bond reform, I'll try to toot about it

#LawFedi Is anyone using a hashtag that flags criminal law? #CrimLaw #CriminalLaw If it's being used, I'm missing it

This morning, the Illinois Supreme Court found that the Pre-Trial Fairness Act can take effect and it will lift it's stay on September 18. In 60 days, Illinois will have no cash bond. The Act is unclear in some areas and contradictory in others, so local courts will be making this up as they go. It means most criminal defendants will be released before trial. Those who are held will be held without possibility of bond. I'll try to post about it as we figure it out. #LawFedi #Crim...

@D_J_Nathanson Illinois has passed some very interesting legislation in the Pre-Trial Fairness Act. So I'll try tooting a bit of the sort of thing I would like to see more of here

@jeridansky @TexasObserver For many small communities, the local prison is an important source of jobs. I didn't know this was happening in high schools, but I am, unfortunately, not surprised

@Teri_Kanefield Agreed. Sticking your finger in the eye of the person with the power is rarely an indication that you want to negotiate. And I can't see him ending any negotiation without a way to proclaim that he won. But then, he thinks he is a master at winning through intimidation, so maybe he has a strategy that includes the possibility of a deal? No, not likely

@pixelpusher220 Many plea bargains involve prison terms, and enforcement there is obvious. If no prison but the defendant (Trump here) is required to do, or not do, things, there is a term of probation or conditional discharge. If he fails to comply, he can be subject to resentencing, which likely includes possibility of prison. The best option for taking a plea bargain then blatantly violating it is to go hide somewhere and stay hidden, which is not very Trump-like

@licked @Teri_Kanefield @noondlyt If Trump is on the ballot, there is a small possibly that he could win. I point this out because there will be Democrats, such as Pritzger, supporting him in the primary bc it makes that blue wave more likely. His strength is bad for the GOP, but it is also bad for the country. Even if he loses the general election, the prominence of his voice is bad for all of us

@noondlyt @licked @Teri_Kanefield I agree that this country is not at all likely to elect Trump again. But I do not think the probability is 0. And a 3% probability of a catastrophic event should not be ignored
