As a hypothetical case, lets assume LLMs get good at coding and someone builds millions of lines of code that exactly duplicate Photoshop or MS Office and its all open source. People start using these LLM clones in masses and stop paying those companies. Let’s see how they react then, because they always claim that’s just how humans learn and that it isn’t copyright infringement. There shouldn’t be any github take downs or copyright infringement lawsuits then, right?

@nixCraft@mastodon.social then let's do exactly that. What should and should not be, is irrelevant at this point.

@nixCraft@mastodon.social hmm but it isn't about what makes logical sense, it's about power. poor people don't have the power to stop AI corpos from stealing their images => so it's allowed rich corpos do have the power to stop the plebs from having an LLM steal their software => so it won't be allowed

@nixCraft@mastodon.social Microsoft stops subsidising OpenAI, charges the project what it actually costs, end of the project. Or just terminates their accounts for breach of the T&Cs. Legality is irrelevant, as demonstrated by the silly YouTube copyright strikes system.

@nixCraft@mastodon.social We can also imagine that next year there is net power from Fusion, Or Putin ends his war, or all Oracle SW is free & open source, or World hunger & homelessness is abolished, or the GOP impeaches Trump & his coterie. These are all more likely than LLMs being good at anything rather than copying.

@nixCraft@mastodon.social As an open source dev of 10 years, I've thought about this a lot. I think copyright was the wrong solution from the start. What should be protected isn't the final code of a project, it's the work that went into it - the human time (which I am told has inherent moral value). It's always harder to be the first to do something because you explore dead ends. SW dev isn't about writing code but making decisions and finding out what works and what doesn't. 1/n

@nixCraft@mastodon.social I mean that's the reality of a world where LLMs deliver on the promise of "solving" programming. Software no longer has any value. All companies whose main capital is IP are dead in the water.

  • @nixCraft@mastodon.social Good question. As I know some people who are very fond of the idea that in the nearer future one has only to ask a language model to build "on the fly" the software currently needed: office tools, video chat pps, (banking apps?), etc. Of cause this has to take place locally, not in a cloudy environment. Total freedom, isn’t it?

@nixCraft@mastodon.social who/what will ML models learn from if human coders stop coding? It can only mimic training data, and has no concept of opinionated design or the kinds of insight that humans have into what will be useful, and teaches new generations of developers to avoid original thought. New devs don't need 50% incoherent and incorrect eco chambers, they need education and actual comprehension of the problems they're trying to solve.

  • @nixCraft@mastodon.social Yeah everyone that's pro-slop seems convinced that a couple of US judges rulings saying genAI output is public domain is the final word on it. And I'm pretty convinced that (1) even in the US, judges are going to start to rule in a more nuanced matter than those rulings expect (indeed, I believe one such ruling dropped this week), and (2) the rest of the world will blindly follow along and (3) the law will never change and even if the "genAI is PD" precedent is upheld one day, those who rely upon copyright protection won't lobby to change those laws. It gets worse because we could end up with copyright laws even more draconian than what we have today. It is perfectly legal today, as the ReactOS and Wine people prove, to copy third party operating systems with a clean room implementation. But what if copyright laws change so that the overall product, not the implementation of the product, is what qualifies for protection? That would be an legislatively easy "solution" that'd keep Microsoft, Oracle, etc, happy, but would have far reaching affects.

@nixCraft@mastodon.social If it's a true clean room implementation I'd say good luck with the lawsuits! And good luck getting it off the the thousands of systems already using it 😂 . The damage is done. The gate has lifted

@nixCraft@mastodon.social This is happening today, and you're right this will accelerate. Further let's say a cease and dissist is issued for infringement of x,y, and z. In a few hours you and your AI have refactored the infringement away, Let's go 💪

    Open ##4989485

  • @nixCraft@mastodon.social Interesting. This is actually happening and what's legal right now is that the AI must not see the original source code and it can try to replicate the functionality of the original products. Underlying code will be completely different, and that's why it's legal (for now).

@nixCraft@mastodon.social let's assume instead the effort is put in developing gimp and libre office instead of in cloning photoshop or msoffice. perhaps while we fight for a better ia we can build better sw. they are not mutually exclusive. your point stands, only the focus shifts

@nixCraft@mastodon.social The issue is, software isn’t a one-off thing like these people assume. Once you make a product, you gotta handle bug reports, add features and maintain it. Can that be done by individuals? I doubt. And then there is the legal angle. None of these companies are gonna sit back and watch as their key products are being reverse engineered. This can sound impressive as a demo but its a whole different game to maintain it.
