Good story in today's NYT by Vimal Patel, about Penn & Amy Wax. https://www.nytimes.com/2023/03/13/us/upenn-law-professor-racism-freedom-speech.html The discussion of her 2017 comments and the responsive faculty open letter that I organized is unusually informative. For anyone who’s interested, the quote from me, in the last paragraph that involves me, came from an email I sent to a lawyer from Quinn Emanuel.

@jciv@home.social Thanks, John. I do wish the quote had been situated more in the fuller context, for the reason you give. Still, this story is so much better than so much of what has been written on the matter that I'll take it.

@davidlnoll@mastodon.lawprofs.org it’s regular media and all, but I’ve been surprised not to see anyone in the stories I’ve read mention issue preclusion here. Same comment wrt the other defamation suit of Carroll’s that was already pending. I assume that even though trump will be stuck with the liability determination (assuming no appellate reversal), it will be harder to establish substantial damages for future instances of defamation. Would be glad to find out I’m wrong on that!
