This is because USA is one of the few countries in the world that doesn't have loser pays laws. He should have to pay MSNBC's legal fees.

It's not automatic, but MSNBC can sue to recover those fees. However, it's still a pretty high bar.

We have "loser pays" contracts and "loser pays" countersuits. "Loser pays laws" can also inhibit individuals from filing legitimate lawsuits in the first place out of fear.
